Welcome to the Philipstown WireCar Foundation website! By accessing or using this site, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

By using our website and services, including browsing or purchasing products, you agree to comply with these Terms and Conditions and any additional policies referenced herein. These terms apply to all users, including browsers, customers, merchants, and contributors of content.

If you do not agree to these terms, please do not use our website.

2. Account Creation and Responsibilities

  • Certain areas of the website may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate, complete, and current information when creating an account.

3. Products and Services

We offer handcrafted wire cars and related merchandise (T-shirts, sweatshirts, hoodies, caps).

  • Wire Cars: Each piece is handmade from recycled materials and different types of wire. Minor variations in design, wire thickness, or colour are part of their unique charm.
    • Large Cars: Designed for racing and active play. Some bending of wires or dislodged wheels is normal and can be repaired by the customer.
    • Small Cars: For display only; not intended for active play.
  • Merchandise: Sizes and measurements are provided. Slight colour variations may occur due to screens or manufacturing.

4. Orders and Acceptance

  • Placing an order constitutes an offer to purchase the item(s) from the Foundation.
  • The Foundation reserves the right to accept or refuse orders at its discretion. Orders may be declined for reasons including product availability, errors in pricing or descriptions, or suspected fraudulent activity.
  • Once an order is accepted, you will receive a confirmation email.

5. Payment, Taxes, and Fees

  • All prices are in South African Rand (ZAR).
  • Payment is processed securely through Shopify and supported payment gateways.
  • You are responsible for any applicable taxes, duties, or import fees on international orders if special arrangements are made.
  • Orders will not be shipped until full payment is received.

6. Shipping

  • Courier Service: All orders are shipped via The Courier Guy.
  • Domestic Shipping Times:
    • Standard Economy: 36–120 hours (1.5–5 days)
    • Same-Day Express: Available within the same city; book before 10:00 AM for delivery by 5:00 PM
    • Overnight Delivery: Inter-city deliveries average 4–6 hours
  • International Shipping: Currently not available. Customers outside South Africa must contact the Foundation for special arrangements.
  • Shipping costs are calculated at checkout. Customers are responsible for providing an accurate address.

7. Returns and Exchanges

Wire Cars:

  • Returns accepted only for items damaged or defective upon arrival, reported within 7 days.
  • Large racing cars may bend or have dislodged wheels due to normal use — this is not considered a defect.
  • Wire car makers are available to guide customers in assembly and setup.

Merchandise:

  • Returns accepted only for manufacturing defects or damage during delivery, reported within 7 days.
  • Size exchanges are not possible due to the remote location of the Foundation.

How to Request a Return:

1.      Email website@philipstownwirecar.com with your order number, photos of the item, and a brief description.

2.     The Foundation will review the claim and provide instructions for return, replacement, or refund.

3.     Approved claims are typically processed within 7–10 business days.

8. Warranty

Wire Cars:

  • Minor bending or wheel dislodgement from use is not a defect. Only major manufacturing faults are eligible for warranty.

Merchandise:

  • Covered for manufacturing defects or damage during delivery. Not covered: sizing errors, colour variations, or wear from normal use.

9. Data Collection and Privacy

  • The Foundation collects personal data for order processing, marketing, and improving the website.
  • We use Shopify and other third-party services to handle payments, shipping, and analytics.

10. Cookies and Analytics

  • Our website uses cookies to improve user experience, track preferences, and analyse site traffic.
  • By using the site, you consent to our use of cookies.

11. Intellectual Property

  • All content, including text, graphics, logos, and images, is owned by the Foundation and protected by copyright and trademark laws.
  • Users may not copy, reproduce, or redistribute content without permission.

12. User Conduct

  • You agree not to misuse the website, including by attempting to gain unauthorized access, interfere with site functionality, or upload harmful content.

13. Limitation of Liability

  • To the fullest extent permitted by law, the Foundation is not liable for any indirect, incidental, special, or consequential damages, including lost profits, data, or goodwill.
  • We are not liable for product misuse, assembly errors, or damage during play.

14. Third-Party Services

  • The Foundation uses third-party services (Shopify, Courier Guy, payment processors) to fulfil orders. We are not responsible for actions, errors, or failures of these third parties.

15. Governing Law and Jurisdiction

  • These Terms are governed by the laws of South Africa.
  • Any disputes will be subject to the exclusive jurisdiction of South African courts.

16. Changes to Terms

  • The Foundation reserves the right to modify or update these Terms at any time.
  • Updated versions will be posted on this page with the revision date.
